Synopses & Reviews

Synopsis:

In their professional lives, courtroom lawyers must do these two things: speak persuasively and write persuasively. In this noteworthy book, two of the most noted legal writers of our day - Justice Antonin Scalia and Bryan A. Garner - systematically present every important idea about judicial persuasion in a fresh, entertaining way. Making Your Case: The Art of Persuading Judges is a guide for novice and experienced litigators alike. It covers the essentials of sound legal reasoning, including how to develop the syllogism that underlies any argument. This is a manual intended for use by a specific segment of the legal profession--appellate attorneys. However, it is written in a non-technical and largely jargon-free manner so it is accessible to a lay reader. I found it to be informative as to the process by which courts decide the law. Antonin Scalia is an associate justice of the nation's highest court, and well known as right wing icon, whose legal credentials are never successfully attacked. Yet there is zero politics in this book. Bryan Garner is a law professor well known for his legal writing seminars where he pushes a new, clearer, simpler writing style. The two authors work well together to produce a manual for attorneys that I found to be helpful and which may be informative to non-lawyers interested in the majesty of the law. It is not burdened with too many war stories or anecdotes, just concisely written advice.
