This study investigates the conditions of legitimate rule and argues that legitimacy can only be realized in a tiered global order. It criticizes theories of justice, democratic theory, legal philosophy, and philosophy of human rights and international relations, while developing a conception of transnational democracy. This conception connects states and other forms of organization into a global legal network that guarantees conditions of freedom in and between states.

Diese Studie untersucht die Bedingungen legitimer Herrschaft und begrundet, dass sie nur in einer gestuften globalen Ordnung realisiert werden konnen. Dabei werden im ersten Teil Ansatze der Gerechtigkeitstheorie, Demokratietheorie und Rechtsphilosophie kritisch gewurdigt und ein allgemeiner Entwurf von Legitimitat auf der Grundlage eines republikanischen Freiheitsbegriffs entwickelt. Dieser Entwurf integriert individuelle und politische Aspekte der Freiheit, indem er Rechtsstaatlichkeit und Demokratie als entscheidende Merkmale legitimer Herrschaft auszeichnet. Im zweiten Teil wird in Auseinandersetzung mit zentralen Stromungen der politischen Philosophie und Theorie des Volkerrechts sowie der internationalen Beziehungen ein eigenstandiges Modell transnationaler Demokratie konzipiert. Dieses Modell verbindet Uberlegungen zur Gestalt und Notwendigkeit von Einzelstaaten und anderen politischen Organisationsformen mit der Vorstellung eines globalen rechtsstaatlichen Netzwerks. Erst in dieser Kombination ist gewahrleistet, dass die Verhaltnisse in und zwischen den Staaten und sonstigen Organisationen freiheitsverburgend verfasst bzw. nicht-beherrschend sind und somit Anspruch auf Legitimitat erheben konnen.
