Daily Dose Official Rules

1. ELIGIBILITY
Employees of Powell's Books and the immediate family or members of their same households of such employees are not eligible. By entering, you (and your parents and legal guardians if you are a minor) agree to these Official Rules and the decisions of Powell's, which are final and binding in all respects.

Powell's reserves the right to change, alter or modify the eligibility and prize for the Daily Dose contest. Any such change, alteration or modification will be announced, in a manner deemed appropriate by Powell's, in which case the change, alteration or modification will become effective on the following day's drawing. Powell's reserves the right to discontinue the Daily Dose contest at any time.

No purchase is necessary to enter Powells.com's Daily Dose contest.

2. CONTEST PERIOD AND PRIZE ALLOCATION
The daily contest period begins on 12:01 a.m. Pacific Time (PT), and ends on 11:59:59 p.m. PT.

Beginning on Wednesday, October 10, 2001, Powell's will allot $20 of store credit per day to the contest prize. Powell's will post one submission per day. Should a prize be claimed by its rightful winner during the contest period, the contest prize reverts to $20 for the purposes subsequent drawings.

3. ENTRY
Add a customer comment to a product on Powells.com; before previewing your comment, click on the box marked "Daily Dose." All applicable Terms and Conditions related to customer comments apply. Once your comment has been submitted (with the relevant box checked) you will be entered in the Daily Dose contest. Unless otherwise advised on Powells.com, any other attempt at entry (including, but not limited to, email or in-store entry) is void.

Powells.com is not responsible for service interruptions or any other technical difficulties that may affect the schedule of posting and redemption features associated with this contest. No responsibility is assumed for lost, incomplete, misdirected, or illegible entries; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, interrupted transmissions, or service provider and/or web site accessibility or availability.

Entrants may submit as many comments as they like for consideration.

4. DRAWING
Each day at 12:01 a.m. (Pacific Time), Powells.com will post a new featured title alongside the contributor's first name and city and state of residence on our Daily Dose page and in our Daily Dose mailing. To claim the contest prize, the contributor must visit Powells.com's prize redemption page and enter the exact email address matching the one associated with the original submission by 11:59 p.m. PT of that same day.

Members of the Powell's content team will select each daily feature from a pool of previously submitted entries based on its suitability for feature presentation on Powells.com. Factors may include availability or suitability of a title for promotion as determined by Powell's staff. Powell's reserves the absolute right to reject or approve titles for promotion according to the criteria it deems relevant.

Only one contributor is eligible to win per day. In the event that multiple contributors have recommended the same title, Powell's may use the First Name or Last Name submitted by contributors to help differentiate between entrants; however, the email address associated with our featured recommendation, as selected by Powell's staff, shall serve as the ultimate and sole tool of all prize claims and allocation.

Submissions may not be featured more than once. Separate submissions remain eligible regardless of a contestant's prior collection of the contest prize.

5. PRIZE/ODDS
The daily contest prize is a $20 credit, redeemable online at Powells.com. For every day the prize goes unclaimed, another $20 credit will be added to the prize total until such time as a prize is claimed according to the guidelines outlined in these official rules.

When a prize is claimed by its rightful winner, the Daily Dose contest enters remission until 12:01 a.m. of the following day, at which time the prize value reverts to $20 credit and a new title and contributor is posted. One submission will be selected per contest period. Odds of winning in any drawing depend on the number of eligible entries received for that drawing. The contest prize may not be redeemed in our physical stores nor may it be redeemed for cash.

6. GENERAL CONDITIONS
Prize winners agree to grant to Powell's the right to print, publish, and use, at any time or times, the winner's name for advertising, trade and promotional purposes without additional consideration.

Powell's reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Daily Dose contest or the Powell's web site; to be in violation of the Terms of Service of the web site; to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and persons thus engaged.

7. LIMITATIONS OF LIABILITY
Powell's is not responsible for any incorrect or inaccurate information, whether caused by web site users, or tampering or hacking, or by any of the equipment or programming associated with or utilized by Powell's and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the web site.

8. DISPUTES
As a condition of participating in this contest, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the state of Oregon having competent jurisdiction, which Court shall apply the laws of the State of Oregon without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this contest), and participant further waives all rights to have damages multiplied or increased.
