Excerpt from Report of Cases Determined in the Court of Chancery, Vol. 1: And in the Prerogative Court, and on Appeal, in the Court of Errors and Appeals, of the State of New Jersey
The bill in this case was filed on the twenty-eighth of Janu ary, eighteen hundred and forty-five, by devisees under the will of Benjamin B. Cooper, deceased, against the defendant, as an executor of and trustee under the will, for an account, and for an injunction restraining him from any further exercise of power as executor or trustee, and from cutting timber on the lands of the estate. The injunction was granted as prayed for. The defendant filed his answer, and thereupon moved to dissolve the injunction. The facts will sufficiently appear in the opinion of the court.
