Der Gesetzgeber hat sowohl das Marktmissbrauchsrecht als auch den Rechtsrahmen f r Hedging-Gesch fte in den letzten Jahren umfassend reformiert. Nach der Darstellung der konomischen Grundlagen des Hedging analysiert die Autorin die M glichkeiten der Widerlegung der Nutzungsvermutung von Insiderinformationen bei Hedging-Gesch ften durch die neu normierten legitimen Handlungen und die bereits bisher anerkannten Fallgruppen. Im Hinblick auf Sinn und Zweck des Insiderhandelsverbots und die Erkenntnisse der Behavioural Finance er rtert sie die M glichkeit einer ungeschriebenen Hedging-Ausnahme.
